These Terms of Service ("Terms") govern your access to and use of the ExamPath website, services, and applications (the "Service"). Please read these Terms carefully, and contact us if you have any questions. By accessing or using our Service, you agree to be bound by these Terms.

1. USING OUR SERVICE

A. Who Can Use the Service

You may use our Service only if you can form a binding contract with ExamPath, and only in compliance with these Terms and all applicable laws. When you create your ExamPath account, you must provide us with accurate and complete information. Any use or access by anyone under the age of 13 is prohibited. If you open an account on behalf of a company, organization, or other entity, then "you" includes you and that entity, and you represent and warrant that you are authorized to grant all permissions and licenses provided in these Terms and bind the entity to these Terms, and that you agree to these Terms on the entity's behalf.

B. Our License to You

Subject to these Terms and our policies, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service.

2. YOUR CONTENT

A. Posting Content

ExamPath allows you to post content, including text, links, and other materials. Anything that you post or otherwise make available on our Service is referred to as "User Content." You retain all rights in, and are solely responsible for, the User Content you post to ExamPath.

B. How ExamPath and Other Users Can Use Your Content

By making any User Content available through the Service, you grant to ExamPath a non-exclusive, transferable, worldwide, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Service to you and to other users.

C. Rules and Conduct

You must not post User Content that:

  • violates any law or regulation;
  • is libelous, defamatory, abusive, threatening, harassing, hateful, offensive, or otherwise violates any third party's legal rights;
  • contains a virus, trojan horse, worm, time bomb, or other computer programming routine or engine that is intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or information;
  • remains on the Service after we've notified you to remove it;
  • is intended to create any undue burden on ExamPath's Service or its users.

D. How Long We Keep Your Content

Following termination or deactivation of your account, or if you remove any User Content from ExamPath, we may retain your User Content for a commercially reasonable period of time for backup, archival, or audit purposes. Furthermore, ExamPath and its users may retain and continue to use, store, display, reproduce, re-pin, modify, create derivative works, perform, and distribute any of your User Content that other users have stored or shared through ExamPath.

3. SECURITY

We care about the security of our users. While we work to protect the security of your content and account, ExamPath cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account.

4. THIRD-PARTY LINKS, SITES, AND SERVICES

Our Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by ExamPath. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from ExamPath, you do so at your own risk and you agree that ExamPath will have no liability arising from your use of or access to any third-party website, service, or content.

5. INDEMNITY

You agree to indemnify and hold harmless ExamPath and its officers, directors, employees and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), arising out of or in any way related to (i) your access to or use of the Service, (ii) your User Content, or (iii) your breach of any of these Terms.

THE SERVICE AND ALL CONTENT IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY CONTENT.

7. LIMITATION OF LIABILITY

10. GOVERNING LAW

These Terms shall be governed by the laws of India, without respect to its conflict of laws principles. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by courts in New Delhi, India.

11. ENTIRE AGREEMENT

These Terms constitute the entire and exclusive understanding and agreement between ExamPath and you regarding the Service, and these Terms supersede and replace any and all prior oral or written understandings or agreements between ExamPath and you regarding the Service.
